Short version:
This federal law allows employees to take up to 12 weeks per year of unpaid time off work for serious health conditions, including physical or mental health, to care for a family member and other reasons.
You can also request intermittent time off that is not a continuous period of time for a limited number of hours per year.
To qualify for FMLA, you need to work for at least 12 months and 1250 hours.
To be used for mental health you need to have symptoms and severity that qualify as a mental health diagnosis that requires ongoing treatment by a licensed professional: therapist, psychiatrist, or primary care physician.
You cannot be denied attendance to your appointments regarding FMLA even if appointments are during your work hours.
This is not a get-out of jail free card. FMLA cannot be used to avoid a mandate. Intermittent FMLA is used for a flare up of a medical condition, however, this flare up may occur at work at any time resulting in your need to go home at that moment as you are deemed unfit for duty at that time.
You cannot be denied use of your FMLA or asked to wait several hours for “proper relief” as you are stating you are unfit for duty at the time of your flare up and must leave at that time. If this happens, report the incident to your supervisor, HR, your union, and the US Department of Labor.
Contact a licensed professional that you will see for ongoing treatment to complete FLMA forms if your physical or mental health conditions limit your ability to work.

If you believe your FMLA rights are being violated or you’re being punished, retaliated against, or harassed for using FMLA, you can file a complaint at the link below. You will need specific dates, times, people involved. The US Department of Labor takes these violations seriously and does reach out personally to address these issues. I have actually spoken to a real person on behalf of my clients being denied use of their FMLA.
